General Terms and Conditions with Customer Information

1. Scope

These General Terms and Conditions ("GTC") of TechnologyONE Germany e.K. ("Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur ("Customer") concludes with the Seller via the Seller's online shop.

The inclusion of the Customer's own terms is rejected unless otherwise expressly agreed.

These GTC also apply to contracts for the delivery of goods with digital elements, i.e. goods containing digital content or services provided by the Seller.

  • A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
  • An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in exercise of their trade, business, or profession.

2. Conclusion of the Contract

  • The product descriptions in the Seller's online shop do not constitute binding offers.
  • The Customer submits a binding offer by completing an order via the online form, telephone, fax, email, post, or contact form.
  • The Seller may accept the offer within five days:
    • by confirming the order in writing or via email,
    • by dispatching the ordered goods,
    • or by requesting payment.

If the Seller does not accept within five days, the Customer is no longer bound.

The contract language is German. Communication and order processing usually take place via email. The Customer is responsible for ensuring a correct and accessible email address.

3. Right of Withdrawal

Consumers generally have a statutory right of withdrawal. Details are provided in the Seller’s separate cancellation policy.

4. Prices and Payment Terms

  • All prices include statutory VAT. Shipping costs are shown separately.
  • Available payment methods are displayed in the online shop.
  • If advance payment is agreed, payment is due immediately.
  • PayPal payments are subject to PayPal’s terms.
  • If purchase on account is offered, the invoice is due within 14 days. The Seller may refuse after a credit check.

5. Delivery and Shipping Conditions

  • Delivery is made to the Customer’s specified address.
  • Risk passes to the Customer upon handover; for entrepreneurs, risk passes upon dispatch.
  • If self-delivery fails, the Customer will be informed, and payments refunded.
  • Self-collection is not possible.

6. Retention of Title

The Seller retains ownership until full payment is received.

7. Liability for Defects (Warranty)

Statutory warranty rights apply.
For entrepreneurs:

  • The Seller chooses the type of supplementary performance.
  • The limitation period does not restart with replacement delivery.
  • § 377 HGB (duty to inspect and notify defects) applies.

Consumers are encouraged (but not obliged) to report transport damage to the carrier and notify the Seller.

8. Redemption of Promotional Vouchers

  • Vouchers are valid only for the specified period.
  • They must be redeemed before order completion.
  • Multiple vouchers may be used per order.
  • No cash payout.
  • Refunds exclude vouchers.
  • Vouchers are transferable.

9. Applicable Law

German law applies, excluding CISG.
For consumers, this applies only if it does not restrict mandatory consumer protection laws of their residence.

10. Jurisdiction

If the Customer is an entrepreneur, the Seller’s registered office is the place of jurisdiction. The Seller may also sue at the Customer’s location.

11. Code of Conduct

The Seller adheres to the Trusted Shops quality criteria (available at www.trustedshops.de).

12. Alternative Dispute Resolution

The EU Commission provides a platform for Online Dispute Resolution: https://ec.europa.eu/consumers/odr/

The Seller is neither obliged nor willing to participate in dispute resolution before a consumer arbitration board.
